Markiewicz that the driver was suspected of being intoxicated. After phone conversations with another patrolman and a sergeant from a neighboring town who confirmed the suspicion of intoxication, Ptl. Markiewicz instructed the other patrol officer to transport the driver to the hospital instead of taking him into custody. Ptl. Markiewicz neglected to investigate the suspected driving under the influence case. No breath or blood sobriety tests were administered to the driver. Additionally, Ptl.
