Interim relief and reconsideration

Beside the appeal itself, an officer or an employer can ask the Commission to act before the case is over, to look at a decision again, or to make a party comply with one. 102 such requests concerning a law enforcement title reached a meeting between January 16, 2019 and September 2, 2026.^[1]

The rule, N.J.A.C. 4A:2-1.2, opens: "Upon the filing of an appeal, a party to the appeal may petition the Civil Service Commission for a stay or other relief pending final decision of the matter."^[2] On what the Commission weighs, it says: "The following factors will be considered in reviewing such requests: 1. Clear likelihood of success on the merits by the petitioner; 2. Danger of immediate or irreparable harm if the request is not granted; 3. Absence of substantial injury to other parties if the request is granted; and 4. The public interest." It adds that "The filing of a petition for interim relief will not stay administrative proceedings or processes."

53 law enforcement petitions for interim relief reached a meeting, and 16 were granted in whole or in part. The minutes item, linked on each row, states what was asked and by whom.

Reconsideration

N.J.A.C. 4A:2-1.6 gives the window: "Within 45 days of receipt of a decision, a party to the appeal may petition the Civil Service Commission for reconsideration."^[3] The petition "must show the following: 1. The new evidence or additional information not presented at the original proceeding, which would change the outcome and the reasons that such evidence was not presented at the original proceeding; or 2. That a clear material error has occurred."

Questions and answers

Can a suspended officer get back to work while an appeal is pending?

A party to an appeal can ask the Commission for a stay or other interim relief while the appeal is decided. The rule lists four factors, starting with a clear likelihood of success on the merits, and says the petition does not itself stop the underlying proceedings.

How long does a party have to ask the Commission to reconsider?

The rule allows 45 days from receipt of the decision. The petition must show new evidence that would change the outcome and was not presented before, with the reason it was not, or a clear material error.
